The fine is the smallest line on the bill
The PIP fine is only the first item. Right after it, backdated contributions, interest and the contractor’s own claims can follow. Below is our approximate estimate for a negative outcome of the proceedings, based on law firm analysis: a developer working 4 years on B2B, a contract of PLN 18,000 net per month, reclassification with a three-year retroactive period.
| Item | Basis | Amount |
|---|---|---|
| Backdated ZUS contributions | ~PLN 22,000 per year × 3 years | PLN 66,000 |
| Late payment interest | accrued on arrears | PLN 12,000 |
| Unused leave compensation | 78 days × ~PLN 700 | PLN 54,000 |
| PIP fine | up to PLN 60,000, up to PLN 90,000 on repeat | PLN 60,000 |
| Total | for a single contractor | PLN 192,000 |
Estimate based on law firm analysis (incl. RPMS). Does not include possible overtime, severance or litigation costs. With more contractors the amounts add up.
In proceedings, the burden of proof lies with you
It is not the inspector who has to prove that you have an employment relationship. It is you who has to show that the cooperation is genuinely independent.
The decision is made without a court
The district inspector issues an administrative decision. An appeal is possible, but you are the party that appeals.
The inspection can be remote
PIP does not have to come in person. Data exchange with ZUS and KAS works regardless of an on-site visit.
